This agency / ticket-messenger model is supported by the Supreme Court of Appeal in On-Line Lottery Services (Pty) Ltd v National Lotteries Board and Another [2009] ZASCA 86; 2010 (5) SA 349 (SCA), where the Court held that such a service, operating as the customer's agent, does not amount to selling lottery tickets and does not constitute the conducting or promotion of a lottery under the Lotteries Act 57 of 1997.
